A U.S. court issued a final judgment requiring Guardant Health to pay more than $245.2 million to TwinStrand Biosciences and the University of Washington after finding it had willfully infringed two patents covering DNA sequencing technologies. The judgment also includes 6% royalties on sales of 11 products and a service until the patents expire in March 2033, while the company plans to appeal the decision.
Guardant Health is seeking to expand use of the Shield test for colorectal cancer detection while developing a new generation designed to improve its ability to detect early-stage disease and precancerous lesions. The company is also working on a multicancer test covering 10 types, but it still needs to gather additional evidence before seeking FDA approval.
